Terms and Conditions

1. General terms and conditions

  • These are the terms and conditions under which you use our website and/or order goods through it. In choosing to do so, you are considered to have read, understood and accepted these terms and conditions.
  • Please read these terms and conditions carefully.
  • Windermere Beds (hereinafter known as WB) is a partnership based in Windermere, Cumbria. The trading name is Windermere Beds and the registered address is Orrest Head Farm, Kendal Road, Windermere, Cumbria LA23 1JG.
  • If you have any queries, comments or complaints concerning any aspect of WB, please do so either by writing to the above address, by using the Contact Us page or by phone (015394 48540). Call charges may vary subject to network, provider and individual contract.

2. Data Protection and Privacy Policy

  • Whilst WB may hold your personal details in order to process your order, for our own marketing purposes and for our own sales monitoring, WB will not make your details available to any other companies. All such information will be held securely and in line with data protection act 1998 and related legal requirements.
  • If you wish to check the information that we hold about you, you may do so by contacting us in writing at the above address. We will amend or remove any inaccuracies.
  • The website is operated by Still Hosting. This policy relates solely to the WB website and not to any others to which the WB website may be linked.

3. Website accuracy and safety

  • All the goods detailed on the website are subject to availability. WB has sought to ensure that all goods are correctly described, priced and all dimensions are accurate. Colour may be subject to slight variation, not least due to the your monitor's display. Where an error appears on the website, WB retains the right to withdraw the goods and cancel all orders (confirmed or otherwise) relating to the error.
  • WB seeks to ensure that this website is free from any viruses. As this cannot be guaranteed, it is your responsibility to ensure that your computer has the correct protection in place and operational to ensure no damage. WB will not be liable for any loss or damage that may result due to the use of this website.

4. Cancellation, amendments and Returns Policy (non bespoke goods)

  • If you cancel within 72 hours prior to delivery, if delivery is refused on the day or no access is granted to the property, you will incur a £50 cancellation fee plus the £35 delivery charge.
  • You have a legal right to cancel your order within 7 days of receiving your goods. We must be notified of a cancellation via e-mail within this period. If you cancel within 7 days of delivery, for reasons of hygiene all items must be unused, undamaged, in the original undamaged packaging and in a re-saleable condition. A charge of £100 for collection will be made. We will not accept goods returned to WB by the customer.
  • Once the order has been confirmed no amendments may be made to the order.
  • All goods should be inspected prior to signing the receipt. If your goods are visibly damaged on delivery, please inform the delivery staff immediately and these will be returned to us. You are requested to detail the nature of the damage on the receipt form. We will arrange for a replacement to be sent out immediately.
  • If upon receipt the goods are found to be faulty you must contact us within 72 hours of delivery by e-mail or telephone. Where this is clearly demonstrated and the goods remain in a new, unused condition, we will collect the goods and provide a replacement at no extra cost. A full refund, less collection costs of £35, may also be provided on request. We will not accept goods returned to WB by the customer.

5. Cancellation, amendments and Returns Policy (bespoke goods)

  • Orders for goods which are bespoke can not be cancelled or amended once the confirmation of order e-mail has been issued except in line with your legal rights.
  • All goods should be inspected prior to signing the receipt. If your goods are visibly damaged on delivery, please inform the delivery staff immediately and these will be returned to us. You are requested to detail the nature of the damage on the receipt form. We will arrange for a replacement to be sent out immediately.

6. Delivery

  • WB will deliver the goods to your specified address. The delivery charge is £35 per address (regardless of number of items). There is no extra charge for deliveries at weekends or evenings. We will aim to deliver your goods to you within 3 weeks from the date of your confirmed order on an agreed date.
  • It is your responsibility to ensure sufficient access for both the vehicle and the goods. Please ensure the goods will not only fit in their desired location but also that they can fit into the property. The delivery charge includes the taking of the goods into the specified address.
  • WB are not able to take or dispose of existing beds/mattresses.
  • If you are unable to take delivery on the agreed date, please notify us in advance and we can arrange storage at a cost of £15 per week.
